I looked at the auction link. How would it not be a C&R?

Generally on everything that qualifies as C&R they post as C&R in the description, helps with selling it.

My understanding is, if someone assembled it on a Form 1, and it is not an original, then it is not C&R.

Would that not be stated? Or is that assumed if “C&R” is NOT stated?

Sorry to derail the thread.

I have no experience to say, personally.

I just asked my SOT friend who has transferred some NFA items that were without a doubt C&R, one example being an MP40 with the original bring back paperwork. The current paperwork did not state C&R anywhere on it.

I guess only the BATF knows if an item is considered C&R in their eyes, since they could trace the paperwork history on an item in their database.

Correct, it does not say on the paperwork, it's based on when it was registered, how it was registered and if it's specifically listed in the C&R list by type or serial number. The M2 60mm mortar is on the C&R list if original and amnesty registered. If it was put together on a form 1 from an original cup and barrel, it's not a C&R because it's a newly manufactured DD by the person filing the form 1 or other non tax pay form. Also the form 1 manufacture is supposed to put their name and city state on the receiver. A lot of times this is not done. Best way to tell if a mortar or ATG is C&R is to ask or FOIA the date of registration.
