This just in from WisDOT! Trans-123 is revived and being presented to the Wis. Legislature. It has been changed some, and I'm not yet sure of the ramifications.

Minnesota: Minnesota law requires that a vehicle comply with federal motor vehicle safety standards, for titling and registration. An imported vehicle must be certified by the importer as meeting federal safety standards. A collector military vehicle, 20 years old or older, may be registered only by a non-profit organization and only for operation as a collector’s item and not for general transportation purposes.
That's interesting.....does this mean any 20-year-old military vehicle or just imported military vehicles?

Chuck,

I cannot tell you the specifics of the Minn. law. As part of an application for an Administrative Rule change, WisDOT presents neighboring state's policies in an attempt to justify their own proposal. The attorney working this matter for the WisDOT, a Mr. Paul Nilsen, has shown himself to be capable of presenting only part of the story in our past dealings with him. Whether this quote accurately, and fully, explains the Minnesota law seems highly suspicious to me.

He's trying to make the case that the Federal exemption given to vehicles which are imported over 25 years old [Title 49 USC 30112(b)(9)] is superseded by State authority, and furthermore WisDOT then seeks to overrule the previous Federal determination that such vehicles are legally imported as "motor vehicles" rather than "off-highway vehicles".

All this, and they're attempting to do it via an Administrative Rule change. This is crucial, because unlike a change to Wisconsin State Law (which requires votes of passage by the Senate Comm. for Transportation, the Assembly Committee for Transportation, the general Senate, the general Assembly, and finally a signature by the Governor), a change to the Wisconsin Administrative Code only requires that the proposal not be voted down by the Senate's and Assembly's Committees.

This sort of back-door politics should be opposed by all Wisconsin citizens, especially any who value their (and others') collectible vehicles - whether exmil or civilian. We citizens must stand up to this abuse of power by our government, or lose our rights. Demand that only our elected officials write our laws. Paul Nilsen should be shown the door.

The submital of the revised Wis Trans 123 rule will not affect former military vehicles that are now covered by the two new Wisconsin laws passed earlier this year.

However the issue is important to collectors in general because it points out that states can continue to look to limiting the driving priviledges of collectors and preservationists now and in the future. We contacted both the SEMA Action Network and the Historic Vehicle Association (a new advocacy group) and notified that Wisconsin Car Clubs Alliance (WCCA) today to get the word out to their old car membership.

The proposed Rule change (LAW) does two things:

1)Federal Law allows import of post 1968 manufactured foreign vehicles and exempts those more than 25 years old from requirements to comply with NHTSA safety requirements. The WI DOT Trans 123 proposal would create a new state law that would override the federal exemption and prevent registration of these collector vehicles in WI.

2)Foreign import vehicles currently registered in WI will be “grandfathered” as long as they remain registered with the current owners until sold and would not be allowed to be registered in WI by a new owner. This reduces the value of current registered vehicles.

Wisconsin residents are urged to quickly contact there legislators and indicate they remain opposed to additional restrictions on collector vehicles.

Catman,

Thanks for chiming in here, and urging others to contact their elected officials.

Jeff is absolutely right about the importance of this issue. We are all vehicle collectors, regardless of whether our vehicle-of-choice is OD green, a fenderless hot-rod, or just an old Jaguar or the like.

Even if it may not involve you directly (this time), WisDOT taking away further rights is unacceptable and ought to be opposed by all collectors.

Please get involved!

Word arrived last night from the State Capitol that a second Senator has agreed to request a Public Hearing on Trans-123.

This is a huge step. Assuming the Committee Chairman does hold a hearing, it will be crucial that Wisconsin citizens attend the hearing and oppose Trans-123.

Remember, unlike proposing a new law, an Administrative Code change passes if neither Committee opposes it. It's critical that we get them to oppose this.

You may think that this is "somebody else's problem". But remember how WisDOT pushed the ex-Military Vehicle collectors around over the past 3 years, and the operating restrictions they put into place for our Milvehs. WisDOT is determined to implement further restrictions on civilian collector vehicles this time.

ALL WISCONSIN COLLECTORS NEED TO STAND UNITED AGAINST WisDOT's TRANS-123.

Requests have been made to the Senate Committee for a Public Hearing. It is now up to the Committee chairman, Sen. Jim Hoperin, to decide to hold it or not.

Please contact Sen. Holperin directly and urge him to conduct such a hearing.

As of this morning Sen. Holperin is still undecided regarding scheduling a public hearing regarding Trans 123.

The deadline is Friday, after which Trans 123 becomes law BY DEFAULT.

Word today from the State Capitol is that Sen. Holperin has agreed to convene a Public Hearing on WisDOT's proposed TRANS-123. The date has not yet been set. I will post it ASAP.

All Wisconsin collectors, of both ex-military and civilian model vehicles, are urged to attend and voice opposition to TRANS-123.

Remember, TRANS-123 was originally written to restrict all exmil vehicles to parade use only, and to outlaw all foreign imports, both civilian and exmil. With the two laws passed earlier this year, exmil vehicles are no longer threatened. But TRANS-123 has been re-written so as to now outlaw all foreign civilian antiques.

Many civilian collectors supported the exmil collectors during the fight over exmil vehicles. Now is your chance to help them out.

We are all Collector people, regardless of the color of our vehicle, O/D or not. If WisDOT gets TRANS-123 enacted, it will contradict Federal regulations, and give WisDOT the authority to overrule the U.S. DOT/NHTSA and the U.S. Customs. We must stand united and get TRANS-123 tossed out completely.

Topic description: relating to registration of non-standard vehicles.

If you don't do anything else this year to benefit the Wis. collectors, attend this hearing and register in opposition to TRANS-123.

If we are unable to raise sufficient objections, this rule will automatically go into effect, and will outlaw any future registration of antique imported vehicles (vehicles which were originally sold in a foreign nation).

This was the same crap which WisDOT tried to shove down the throats of milveh collectors in '09. Now they've targeted civilian vehicles. We need to stop this now.
